Candidate Tax Affidavit Forms Now Available

        JEFFERSON CITY – The Missouri Department of Revenue announced today that the Candidate Tax Affidavit Forms are now available online at http://dor.mo.gov/tax/candidates/.  Those desiring to file as a candidate for election to a public office in Missouri, except those offices exempt pursuant to Section 115.305 RSMo,  must file a Candidate’s Affidavit of Tax Payments (Form 5120) with the Missouri Department of Revenue.  This Affidavit states that the candidate is not delinquent in the payment of any state income taxes, personal property taxes or real property taxes on their place of residence as stated on their declaration of candidacy.  It further states that they are not a past or present corporate officer of any motor vehicle and driver license contract office (also called a fee office) that owes any taxes to the state.

        This Affidavit must be completed by the candidate, signed before a notary, and the Affidavit notarized.  The original Affidavit must be filed with the Missouri Department of Revenue.  A copy of the Affidavit must be attached to the declaration of candidacy filed with the Secretary of State or local election official, if applicable.  The candidate should obscure or remove their Social Security number from the copy of the Affidavit that is attached to their declaration of candidacy.

        The requirement to file the Affidavit is mandated by Section 115.342, RSMo, which took effect on January 1, 2007.
